Last contact is sort of how it is anyways. At least for VAR - they always go to the frame before there is 'space' between the foot and the ballI suspect it would be treated as unsporting behaviour or something equivalent - as it it a clear attempt to bypass the intention of offside laws.
It would be similar to the USA men's team trying to touch a corner kick with their foot to put the ball in play then wandering off and leaving the ball for someone else to come and unexpectedly run with. The ref just sent them back and told them to kick it properly even though, technically, there was nothing wrong with the play in the laws.
'Against the spirit of the game' would equate to unsporting behaviour in my eyes as a safety net/catch all.
Worse thing about it is it might encourage FIFA to change the laws to last contact rather than first - making it even harder for attacking play and officials.
